TERMS OF SERVICE

Welcome to SDS Auto Detailing ("SDS Auto Detailing," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website located at sdsdetail.com (the "Site") and the mobile auto detailing services we provide (collectively, the "Services"). By booking, scheduling, paying for, or receiving Services, or by using the Site, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree, please do not use our Services or the Site.

SDS Auto Detailing is a sole proprietorship operating in Hillsborough County, Florida, United States.

1. Services Offered

SDS Auto Detailing provides mobile auto detailing services, including but not limited to:

- Interior detailing and deep cleaning

- Exterior hand wash and detailing

- Ceramic coating application

- Paint correction (single stage and multi-stage)

- Headlight restoration

- Engine bay cleaning

- Pet hair, stain, and odor treatment

- Maintenance detailing packages

A full and current list of Services, packages, and pricing is available at sdsdetail.com/services/. We reserve the right to modify, suspend, or discontinue any Service at any time, with or without notice.

2. Service Area

We provide mobile Services to Sun City Center, Ruskin, Wimauma, Apollo Beach, Fishhawk, Valrico, and surrounding communities in Hillsborough County, Florida. Services outside our standard area may be available for an additional travel fee, subject to our discretion and scheduling availability.

3. Booking, Deposits, and Payment

3.1 Booking

Appointments may be booked by phone at 813-553-1553, through our Site, or through any other channel we designate. All bookings are subject to availability and confirmation by SDS Auto Detailing.

3.2 Deposits (Non-Refundable)

A non-refundable deposit is required to secure your appointment:

$25 deposit for all standard detailing services (interior, exterior, wash, maintenance, etc.)

$50 deposit for all paint correction and ceramic coating services

All deposits are applied toward, and will come off of, the final invoice for the completed Service. Your appointment is not confirmed until your deposit is received.

3.3 Final Payment

The remaining balance is due in full immediately upon completion of the Service, unless otherwise agreed in writing. We accept credit/debit cards, and other payment methods that we may list at the time of booking. Returned payments, chargebacks, or failed transactions may incur a $35 processing fee and may result in suspension of future Services.

3.4 Pricing and Estimates

Pricing for Services may vary based on vehicle size, condition, level of contamination (including pet hair, stains, heavy dirt, oxidation, or severe paint defects), location, and other factors. Quotes provided in advance are estimates. Final pricing will be confirmed on site before work begins. By approving the on-site quote (verbally, in writing, or by conduct such as handing over the vehicle), you agree to the final price.

3.5 Taxes and Fees

All prices are exclusive of applicable state and local sales tax, which will be added where required by Florida law.

4. Cancellation, Rescheduling, and No-Show Policy

4.1 Cancellations

All deposits are non-refundable for any canceled Service. If you cancel your appointment, your deposit will not be refunded. However, as a courtesy and at our sole discretion, we may apply your deposit to one (1) rescheduled appointment within 30 days of the original booking date if you contact us at least 24 hours in advance (see Section 4.2).

4.2 Rescheduling

If you need to reschedule, please contact us at least 24 hours before your scheduled appointment. We will make reasonable efforts to apply your deposit to a rescheduled appointment within 30 days of the original booking. Rescheduling is at our sole discretion and subject to availability.

4.3 No-Shows and Access Issues

If our technician arrives at the scheduled location and address and is unable to access your vehicle, cannot locate you, or you are not ready within 15 minutes of the scheduled arrival window, the appointment may be treated as a no-show and the deposit will be forfeited. You may also be charged an additional trip fee before any future booking.

4.4 Cancellation by SDS Auto Detailing

We reserve the right to cancel, reschedule, or refuse Service for any reason, including weather, safety, vehicle condition, site conditions (water/power access, parking, HOA restrictions), or personal safety concerns. If we cancel for reasons within our control, we will either reschedule your appointment or refund your deposit at our option.

5. Weather Policy

Mobile detailing is weather-dependent. In the event of rain, severe heat, freezing temperatures, lightning, or other conditions that would affect the quality or safety of the Service, we may reschedule your appointment. When we reschedule for weather, your deposit is preserved and applied to the new appointment. No refunds are issued for weather-related rescheduling.

6. Customer Responsibilities

To allow us to perform Services safely and effectively, you agree to:

- Provide a safe, legal, and accessible location for the vehicle

- Remove all personal items, valuables, money, electronics, documents, child seats, and loose items from the vehicle before our arrival

- Disclose any known mechanical, cosmetic, electrical, upholstery, paint, or glass issues in advance

- Provide access to water and/or a 110V electrical outlet if requested at time of booking (unless a package specifically includes self-contained water and power)

- Ensure the vehicle is unlocked or that keys are provided at the start of the appointment

- Obtain any necessary permissions from HOAs, landlords, property managers, or employers for mobile service at your chosen location

If you fail to meet these responsibilities and we cannot complete the Service, the appointment may be treated as a no-show under Section 4.3.

7. Vehicle Condition, Disclaimers, and Risk

7.1 Inherent Risks of Detailing

Auto detailing involves cleaning, polishing, and chemical treatments. Certain pre-existing conditions may be revealed, worsened, or exposed during or after Service, including but not limited to:

- Clear coat failure, peeling paint, oxidation, or thinning paint

- Previous body work, overspray, touch-up paint, or aftermarket coatings

- Cracked, loose, or failing trim, emblems, moldings, or weather stripping

- Water intrusion through damaged seals, sunroofs, windows, or body panels

- Chips, cracks, or damage to glass, lights, or plastics

- Rust, corrosion, or electrical sensitivities

- Mold, mildew, biohazards, or allergens

- Delicate or non-original interior materials (wraps, vinyl, aftermarket leather, etc.)

You acknowledge that SDS Auto Detailing is not liable for damage, deterioration, or exposure of these pre-existing conditions that occurs in the normal course of detailing.

7.2 Paint Correction and Ceramic Coating Disclaimer

Paint correction is a process that removes a measured layer of clear coat to remove defects. Results depend on the condition and thickness of existing paint. Some defects may be too deep to safely remove. Ceramic coatings are a semi-permanent protective layer; longevity depends on proper maintenance, washing practices, environmental exposure, and other factors outside our control. We do not guarantee the removal of every defect or any specific lifespan of a coating beyond what is expressly stated in writing for that specific package.

7.3 Personal Property

We are not responsible for personal property left in the vehicle. Please remove all valuables, electronics, cash, documents, and personal items prior to Service. Any items left in the vehicle are left at your sole risk.

8. Satisfaction, Re-Do, and Refund Policy

We stand behind our work. If you are not satisfied with a completed Service, you must notify us in writing at [email protected] within 72 hours of completion, with specific details and photos of the issue. Our sole obligation, and your sole remedy, is that we may, at our option, return to address the specific issue within a reasonable time, at no additional charge. Deposits and payments for completed Services are otherwise non-refundable.

9. Damage Claims

If you believe that damage occurred to your vehicle or property as a direct result of our Services, you must:

- Notify SDS Auto Detailing in writing at [email protected] within 72 hours of completion

- Provide clear photographs of the claimed damage

- Preserve the condition of the vehicle until we have had a reasonable opportunity to inspect

Failure to notify us within 72 hours waives any claim. Our aggregate liability for any damage claim is limited as described in Section 11.

10. Intellectual Property; Use of Before/After Photos

All content on the Site, including logos, text, graphics, and images, is the property of SDS Auto Detailing or its licensors and is protected by U.S. copyright and trademark law. You may not copy, reproduce, or use any of this content without our written permission.

Unless you notify us in writing prior to Service, you grant SDS Auto Detailing a non-exclusive, royalty-free, perpetual license to photograph, video, and use images of your vehicle (excluding license plates, personal identifiers, and any visible personal property) for marketing, advertising, social media, portfolio, and promotional purposes. If you do not want your vehicle photographed, please email [email protected] or notify the technician before Service begins.

11. Disclaimers and Limitation of Liability

11.1 Services "As Is"

Except as expressly stated in these Terms, the Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Florida law, SDS Auto Detailing disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms is intended to waive, limit, or restrict any non-waivable rights you may have under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) or other Florida consumer protection laws.

11.2 Limitation of Liability

To the fullest extent permitted by law, in no event shall SDS Auto Detailing, its owner, employees, contractors, or agents be liable for:

- Indirect, incidental, special, consequential, exemplary, or punitive damages

- Loss of use of the vehicle, loss of income, rental car costs, or diminished value

- Damage caused by pre-existing vehicle conditions as described in Section 7

Our total aggregate liability for any claim arising out of or relating to the Services or these Terms shall not exceed the total amount paid by you to SDS Auto Detailing for the specific Service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless SDS Auto Detailing, its owner, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your misrepresentation of vehicle condition; (c) damage, injury, or loss at your chosen service location caused by third parties, HOAs, or property owners; or (d) your violation of any law or the rights of a third party.

13. Site Use

The Site is provided for informational and booking purposes. You agree not to use the Site in any way that is unlawful, harmful, or that interferes with any other party's use of the Site. We reserve the right to terminate or restrict access to the Site at our discretion.

14. Third-Party Links

The Site may contain links to third-party websites or services. We do not control and are not responsible for the content, privacy practices, or availability of third-party sites. Access to such sites is at your own risk.

15. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. You agree that any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction and venue of those courts.

16. Dispute Resolution

16.1 Informal Resolution

Before filing any formal claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for a period of at least 30 days.

16.2 Small Claims

Either party may bring an individual action in small claims court in Hillsborough County, Florida, for disputes within that court's jurisdiction.

16.3 Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute will be brought on an individual basis only and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a revised "Last Updated" date. Your continued use of the Site or Services after changes are posted constitutes your acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify existing customers.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and any service-specific agreements signed by you (including written ceramic coating or paint correction agreements), constitute the entire agreement between you and SDS Auto Detailing concerning the Services and supersede all prior agreements and understandings.
